Noddle users are responsible for ensuring they have the required rights, notices, permissions, and consents to collect and process Customer Data through the Service.

4. SMS, Phone, and Messaging Privacy
Noddle may allow users to send and receive SMS messages, phone calls, and other communications. Users are responsible for obtaining legally required consent before sending messages or making calls through Noddle.
For SMS programs:
- Message and data rates may apply.
- Message frequency varies.
- Contacts may opt out by replying STOP.
- Contacts may request help by replying HELP.
- Carriers are not liable for delayed or undelivered messages.
No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
5. Cookies and Tracking Technologies
We may use cookies, pixels, tags, local storage, analytics tools, and similar technologies to:
- Operate and secure the website and Service.
- Keep users logged in.
- Remember preferences.
- Understand website and product usage.
- Improve performance and user experience.

We may share information when a Noddle user directs us to do so, such as when sending an email, SMS, invoice, form submission, booking confirmation, notification, webhook, automation, or integration event.
Legal and Compliance Reasons

- Respond to lawful requests from public authorities.
- Enforce our Terms and Conditions.

7. How We Do Not Share Information
We do not sell personal information in the ordinary sense of exchanging it for money.
We do not share SMS opt-in data or consent information with third parties or affiliates for their own marketing or promotional purposes.
We do not use Noddle users' Customer Data to independently market to their contacts unless separately authorized.
8. Customer Data and User Responsibilities
Noddle users are responsible for the Customer Data they collect, upload, import, store, send, or process through the Service.
As a Noddle user, you are responsible for:
- Providing legally required notices to your contacts, customers, leads, subscribers, and website visitors.
- Obtaining required consent for email, SMS, phone calls, marketing, tracking, and data processing.
- Maintaining your own privacy policy and terms where required.
- Honoring unsubscribe, STOP, opt-out, deletion, access, and correction requests where applicable.
- Keeping your contact lists accurate and lawfully obtained.
- Avoiding the use of purchased, scraped, rented, or improperly obtained contact lists.
- Complying with privacy, marketing, consumer protection, communications, and data protection laws that apply to your business.
Noddle is a tool. It does not replace your responsibility to operate your business lawfully.
9. Data Security
We use reasonable administrative, technical, and organizational measures designed to protect information from unauthorized access, loss, misuse, disclosure, alteration, or destruction.
However, no system is perfectly secure. We cannot guarantee absolute security of information transmitted to, stored in, or processed through the Service.
You are responsible for:
- Keeping login credentials secure.
- Using strong passwords.
- Enabling multi-factor authentication where available.
- Managing user permissions carefully.
- Removing access for former employees, contractors, or team members.

12. Marketing Communications
We may send administrative, transactional, support, billing, and service-related communications. These are necessary for the operation of the Service and may not always include an unsubscribe option.
We may also send marketing communications where permitted by law. You may opt out of marketing emails by using the unsubscribe link or contacting us.
Opting out of marketing communications does not prevent us from sending account, billing, legal, security, or service-related messages.
13. Children's Privacy
Noddle is intended for business use and is not directed to children under 13. We do not knowingly collect personal information from children under 13.
If you believe a child has provided personal information to us, contact us and we will take appropriate steps to delete it where required.
